Sure - get a Change of Title Deed drawn up - your solicitor can do it with Office Copies - easy!
Reply:Yes. Effectively you would be taking out a new mortgage to pay off the old joint one, so the bank would want to check that you can afford the new one.
Reply:take a loan out and pay off rthe old one and his name is off it but he does need to sign off the title amd if you are trying to takr away from him he can take youy to court so make sure he wants to give you the house if you guys have no kids he is entitled to some of the money out og the house he owns half and that is thew law
Reply:I think you will need to get a solicitor to draw up the paperwork. You will both need to agree to the mortgage now being in one name only.
Reply:All you have to do is file a quit claim deed with the other party. It is very easy and any attonery can give you the paper work for it or you can find the form on the internet. Fill out the form and take it to the register of deeds and record it

Reply:There are problems with this, affordability and if you want to stay with your old mortgage provider are they happy to do this.
Dont forget while you are both on the application for the first mortgage you are both liable (and will be for years to come if your home is repossessed).
Is your sole income enough to satisfy the lending requirements of the society, dont forget they look at affordability issues as well, so you cant them say my partner will finance the other bills if she is not on the application.
Lots of people are trying to remove themselves from the liability of a mortgage at the moment its not as black and white as it first appears.
If affordability is not an issue it may be possible.
